Note on the authoritative language: This English text is a non-binding convenience translation. The legally binding and authoritative version is the German original (available at regfish.de/legal/withdrawal). In the event of any discrepancy between this translation and the German version, or in the event of a dispute, the German version shall prevail. This withdrawal instruction is addressed exclusively to consumers (hereinafter uniformly referred to as “consumer”). A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or self-employed professional activity (section 13 of the German Civil Code (BGB)). Business customers (entrepreneurs within the meaning of section 14 BGB) are not entitled to a statutory right of withdrawal. As the offering of regfish GmbH is directed predominantly at commercial and business customers, this instruction is only applicable where you enter into the contract as a consumer for private purposes. If you enter into the contract as a business customer, the following provisions do not apply.

A. Withdrawal Instructions

Right of withdrawal

(1) You have the right to withdraw from this contract within fourteen days without giving any reason. (2) The withdrawal period is fourteen days from the day on which the contract was concluded. (3) In order to exercise your right of withdrawal, you must inform us regfish GmbH Bleichstraße 8a 35390 Gießen Germany Telephone: 0641 / 49 888 530 E-mail: support@regfish.de by means of a clear statement (e.g. a letter sent by post or an e-mail) of your decision to withdraw from this contract. You may use the attached model withdrawal form for this purpose, although its use is not mandatory. (4) In order to comply with the withdrawal period, it is sufficient that you send the communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Consequences of withdrawal

(1) If you withdraw from this contract, we shall reimburse to you all payments received from you without undue delay and at the latest within fourteen days from the day on which we receive the communication concerning your withdrawal from this contract. For such reimbursement, we shall use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no event shall you be charged any fees as a result of such reimbursement. (2) If you have requested that the services should commence during the withdrawal period, you shall pay us a reasonable amount corresponding to the proportion of the services already provided up to the time at which you notify us of the exercise of the right of withdrawal in respect of this contract, in comparison with the full scope of the services provided for in the contract.

Online withdrawal function

(1) You may also exercise your right of withdrawal via our online withdrawal function at regfish.de/legal/withdrawal. If you use it, we shall send you, without undue delay, a confirmation of receipt of your withdrawal on a durable medium. End of the withdrawal instructions.

B. Expiry of the Right of Withdrawal

Early expiry in the case of fully performed services

(1) In the case of a contract for the provision of services (e.g. domain registration, domain transfer and domain renewal, DNS services including DNSSEC, DynDNS, Hidden Primary and DNS automation, e-mail services, web hosting and WordPress hosting, web forwarding, as well as the use of the API), your right of withdrawal expires if we have fully provided the service and only began performance after you have given your express consent thereto and at the same time confirmed your awareness that you lose your right of withdrawal upon complete performance of the contract by us (section 356(4) BGB).

Early expiry in the case of digital content and digital products

(1) In the case of a contract for the supply of digital content not supplied on a tangible medium, or of digital products (e.g. TLS/SSL certificates, S/MIME certificates and code-signing certificates, in each case including wildcard and SAN/multi-domain variants), your right of withdrawal expires if we have begun performance of the contract after – you have expressly consented to our beginning performance before the expiry of the withdrawal period, – you have confirmed your awareness that, by giving your consent, you lose your right of withdrawal upon the commencement of performance, and – we have provided you with a confirmation of the contract on a durable medium (e.g. by e-mail) (section 356(5) in conjunction with section 312f(3) BGB).

Note on domain registrations

(1) In the case of the registration of domain names individually specified by you, the service is regularly provided immediately and in full upon registration, connection or transfer with the competent registry (e.g. DENIC eG, EURid, nic.at, Nominet). (2) For this reason, during the ordering process we obtain your express consent to the immediate commencement of performance and have you confirm your awareness that you lose your right of withdrawal upon complete performance of the contract. If you expressly consent to the immediate commencement and confirm this awareness, your right of withdrawal expires upon the completed registration (section 356(4) BGB).

C. Online Withdrawal Function (Withdrawal Button)

(1) You may also declare your withdrawal via our online withdrawal function. For this purpose, throughout the entire withdrawal period, a clearly visible, easily accessible and prominently placed button labelled “Withdraw from contract” is available to you at regfish.de/legal/withdrawal. The button is accessible without prior log-in. (2) After activating the button, you will be directed to a confirmation page on which you provide your name, information identifying the contract (e.g. order or contract number) and the electronic means of communication via which we are to send you the confirmation of receipt of the withdrawal. You can then submit your withdrawal using a second button. We do not require any further information; in particular, you do not have to give any reason for your withdrawal. (3) We shall confirm the receipt of your withdrawal declared via the online withdrawal function without undue delay, stating its content as well as the date and time of receipt, on a durable medium (section 356a BGB).

D. Note for Business Customers and Resellers

(1) If you enter into the contract as a business customer (section 14 BGB), you are not entitled to a statutory right of withdrawal; the foregoing instructions do not apply to you. (2) If, as a reseller, you pass on the services obtained to third parties for consideration, you remain our direct contractual partner. The relationship between you and your own end customers is not a contract with regfish GmbH; any consumer rights of your end customers are directed against you as their contractual partner.
